The scenario
Life doesn’t always go to plan and, sometimes, the path you had originally set out on takes a change in direction. For Emma and James, the time had come to separate after being married for several years. They hadn’t divorced as Emma was diagnosed with cancer and hoped to get better first before sorting out the divorce and preparing her Will.
What went wrong?
She suddenly passed away before she could focus on the divorce process and preparing her Will, with legal rules dictating that her entire estate would pass to her estranged partner as divorce proceedings had not begun.
James got everything, even though he was in a new relationship and engaged to be wed, much to the distress of Emma’s parents, who knew that wasn’t what she would have wanted.
As well as losing their daughter, they also had to engage with the estranged partner in the most difficult of times.
